01What Faxly is
Faxly is an online fax service operated by THEONLINESAASCOMPANY LLC, a Wyoming limited liability company operating as Faxly ('Faxly', 'we', 'us'). We convert documents you upload into fax transmissions, deliver them over telecommunications carrier networks to the numbers you specify, and provide delivery confirmations. Standard plans also include a personal fax number for receiving. These Terms are a binding agreement between you and THEONLINESAASCOMPANY LLC
02Eligibility and your account
You must be at least 18 years old (or the age of majority where you live) to use Faxly. You agree to provide a working email address and keep your account details accurate — receipts, renewal reminders, and legal notices go there. You are responsible for all activity under your account and for keeping sign-in access to your email secure. One account per person or business.
03Acceptable use
You may not use Faxly to send unsolicited advertisements ('junk faxes') prohibited by the Telephone Consumer Protection Act, 47 U.S.C. § 227, and FCC rules, or equivalent laws where you or your recipient are located; to send content that is unlawful, defamatory, harassing, threatening, or fraudulent; to violate another person's privacy or intellectual-property rights; or to impersonate any person or organization. We may suspend or terminate accounts that violate this section, and we cooperate with law enforcement where legally required. To report abuse, use the Report Spam page. Faxly is operated from the United States and complies with US sanctions and export-control laws: we do not transmit to destinations, persons, or organizations that US law prohibits us from serving, and you may not use Faxly from, or for the benefit of, any of them.
04Fax sender identification
US law (47 C.F.R. § 68.318(d)) requires every fax to display the date and time of transmission, the sender's identity, and the sending number in its margin or header. Faxly adds this header automatically using your account information. You agree to keep that information accurate and not to alter or falsify sender identification.
05Electronic communications and E-SIGN consent
By creating an account you consent to do business with us electronically and to receive service communications — receipts, delivery updates, renewal reminders, and legal notices — by email, consistent with the federal E-SIGN Act. If you give us a mobile number for delivery texts, message and data rates may apply and you can opt out anytime by replying STOP. You may withdraw electronic-communications consent by closing your account; we cannot provide the service without it.
06Payment, automatic renewal, and price changes
The 48-Hour Pass costs $1.99 and includes up to 50 pages. UNLESS YOU CANCEL WITHIN 48 HOURS, THE PASS CONTINUES AUTOMATICALLY AS FAXLY STANDARD AT $19.99 EVERY 4 WEEKS (500 pages per cycle) UNTIL YOU CANCEL. We email you before the pass converts and before each renewal window closes, and you can cancel online — the same way you signed up — at any time, as automatic-renewal laws such as California's require. Prices on the English site are in USD and exclude any applicable taxes; prices on the German, French and Italian sites are in EUR and are final prices including VAT where it applies; prices on the Japanese site are in JPY and include consumption tax; prices on the Korean site are in KRW and include VAT. We will give at least 30 days' email notice before any price increase, which applies only to subsequent renewals.
07Cancellation and refunds
You can cancel online in two clicks from Settings, with no cancellation fee and no phone call. Your plan stays active until the end of the period you have paid for. Refunds are handled under our Refund Policy, which is part of these Terms — including full refunds where we failed to deliver at all. Consumers in the EU, the UK and Switzerland also have a statutory 14-day right of withdrawal, explained in our Right of Withdrawal notice: because your fax is sent immediately at your request, that right ends for the service once it has been fully performed. Consumers in Korea have a 7-day right of withdrawal under the E-Commerce Act, explained in the same notice; it too is limited for a fax whose transmission has begun at your request.
08Delivery policy and service availability
Your fax is transmitted as soon as your payment is confirmed, and most faxes arrive within about five minutes; long documents and busy receiving lines take longer, and you can watch the progress live or close the page and wait for our email. Delivery depends on the receiving machine answering and confirming; we retry busy and unanswered lines automatically and report the outcome honestly. If a fax cannot be delivered after our retries, we tell you by email, the pages are not counted against your plan or charged, and you can try again free or resend it to a corrected number from your dashboard. Delivery receipts reflect confirmation from the receiving machine and are your proof of delivery. Faxly delivers to fax numbers in the countries offered in the send form and cannot deliver to destinations subject to US sanctions. We work to keep Faxly available at all times but do not guarantee uninterrupted or error-free service; scheduled maintenance is announced in advance where practical.
09Your content
You retain all rights to the documents you send and receive. You grant Faxly a limited, non-exclusive license to process, convert, transmit, and temporarily store your documents solely to provide the service. We do not read, mine, or use your documents for any other purpose, and they are purged after delivery under our Privacy Policy. You are solely responsible for the content of what you send and for having the right to send it.
10Intellectual property and DMCA
The Faxly name, logo, software, and site design are the property of THEONLINESAASCOMPANY LLC and are protected by law; these Terms grant you no rights in them other than to use the service. If you believe material transmitted through Faxly infringes your copyright, send a notice compliant with the Digital Millennium Copyright Act (17 U.S.C. § 512) to support@faxly.com. We terminate repeat infringers.
11Privacy
Our Privacy Policy — including the California and other state-law disclosures in it — explains what we collect and how we handle it, and is incorporated into these Terms by reference.
12Disclaimers
FAXLY IS PROVIDED 'AS IS' AND 'AS AVAILABLE'. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Faxly is a transmission service: we are not responsible for how recipients handle your documents, and nothing on this site is legal, medical, or tax advice. Some states do not allow certain warranty disclaimers, so parts of this section may not apply to you.
13Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FAXLY'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, AND WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. Some states do not allow these limits, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
14Indemnification
You will defend and indemnify THEONLINESAASCOMPANY LLC and its officers, employees, and agents against claims, damages, and reasonable legal fees arising from the content you transmit, your violation of these Terms, or your violation of law — including TCPA claims arising from faxes you send.
15Arbitration and class-action waiver
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR RIGHTS. Except for small-claims cases and where prohibited by law, any dispute between you and Faxly will be resolved by BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association under its Consumer Arbitration Rules, and the Federal Arbitration Act governs this section. YOU AND FAXLY EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. You may opt out of arbitration entirely by emailing support@faxly.com (subject 'Arbitration opt-out') within 30 days of first accepting these Terms; opting out does not affect any other part of these Terms. Faxly pays arbitration filing fees for consumer claims under $10,000.
16Governing law, changes, and contact
These Terms are governed by the laws of the State of Wyoming, without displacing consumer protections you are entitled to under the laws of your state of residence. If we make material changes, we will email you at least 14 days before they take effect; continued use after that is acceptance. If any provision is found unenforceable, the rest remains in effect. These Terms and the policies they incorporate are the entire agreement. California users: under Cal. Civ.
